It is evident that a large part of the population in the Grand Duchy of Luxembourg undertakes estate planning either very late or not at all.
While important projects such as building a house, buying a car, or other major investments are carefully planned, estate settlement – often the largest transfer of assets in life – is frequently neglected.
Whether it is about determining the modalities of asset transfer during one’s lifetime, or – from the heirs’ perspective – preparing early for the receipt of an inheritance: estate planning is essential. It ensures that the wishes of the deceased are respected, family disputes are avoided, and management complies with both legal requirements and economic and tax interests.

Heriditas brings together lawyers, tax experts, notaries, and real estate specialists. Thanks to this unique combination of legal, fiscal, and real estate expertise, we provide you with comprehensive support – discreet, efficient, and at the highest quality level.

Beyond estate planning, we also take on fiduciary management of your assets upon request. This includes in particular the valuation and sale of inherited properties – with the aim of preserving your assets and ensuring their transfer under the best possible conditions.

Because every inheritance is unique – just like the property or assets it represents. General advice is not enough. At Heriditas, we are fully aware of this. That’s why we take the time to accompany you individually – with expertise and absolute confidentiality.

Tax advice
What taxes are incurred in Luxembourg in connection with an inheritance? What allowances can be claimed? And what must be considered when transferring or selling an inherited property?

Luxembourg inheritance and tax law is complex. While direct inheritances (e.g. in favor of children or the surviving spouse) are generally tax-free, inheritance or gift taxes may be levied on more distant relatives or third parties. In addition – depending on the case – registration and transcription fees as well as a possible taxation of property gains in the event of a later sale may apply.

We provide you with comprehensive advice on all these regulations and show you the best options – whether you want to preserve your assets for future generations or structure the sale of your inheritance under tax-optimized conditions.

Lawyer
Our network of lawyers, tax advisors, notaries, and estate planners offers you interdisciplinary expertise in Luxembourg. We support you in all areas of Luxembourg inheritance, tax, and real estate law.

In disputes within an inheritance community, we represent and defend you, ensuring that your rights and legitimate interests are safeguarded.

Notary
Heirs are often surprised that selling an estate property in Luxembourg is much more complex than initially assumed. A key step is the notarial certification of the purchase agreement, which is mandatory under Luxembourg law.

Drafting such an agreement goes far beyond simply signing a document and requires careful preparation by the seller. Heriditas supports you in Luxembourg from the preparation phase to the signing of the notarial deed – always aiming to avoid legal and tax errors in contract drafting.

Real estate valuation
No property is the same. Factors such as appearance, location, or construction quality are just some of the criteria that determine the value of a property in Luxembourg. The more variables included in the valuation, the more reliable the result – and the greater the chances of selling your property under the best possible conditions.

Heriditas helps you precisely determine the market value of your estate property according to Luxembourg standards – with the aim of achieving the best possible sale price for you.

Bank
The assets held by the deceased with a Luxembourg credit institution are deemed an integral part of the estate – just like all other assets, rights, and values that form part of the inheritance.

To access them, the heirs must, in accordance with applicable legal provisions, prove their status as heirs – for example, by presenting a certificate of inheritance or another notarial deed issued by a Luxembourg notary.

It should be noted that assets held in a joint account do not automatically pass to the heirs. They may wholly or partially belong to the co-holder of the account, e.g., the surviving spouse or a registered partner.

The Heriditas network is available to advise and assist you with all matters concerning estate assets held with banks in Luxembourg.

The difficulties without Heriditas
Without the support of Heriditas, you must make decisions regarding tax and inheritance law on your own – with the risk of not fully benefiting from applicable allowances. The value of your property may be misjudged, exposing you to a sale with financial losses or legal consequences.

The drafting and certification of the purchase agreement requires lengthy and complex preparation, which – if errors occur – can turn to your disadvantage. Finally, without mediation or professional advice, conflicts within the inheritance community risk escalating in the worst case.
